The buildings within the southern portion of Kincora (see “Annual Fee/ Boundary” section) have an encumbrance on the land title. As per the encumbrance, the Kincora Residents Association HOA fees are not optional. These documents should have been reviewed by your real estate agent and/or lawyer when purchasing the property. Updating account contact information and settling the account balance is usually completed during the sale/ purchase process. All of the account balance is the responsibility of the current owner. Unpaid fees will incur late penalties, interest, and possibly collection fees.
The annual fee is used to maintain the green spaces and amenities within the KRA boundary at a level that is superior to the standards that would have been provided for by The City of Calgary. Some funds are used to help support a healthy and active Kincora community.
The KRA board creates the budget based on past budgets/financial statements and directs its energies towards projects to improve Kincora. All budgets are presented to owners before the start of the budget year.

Landscaping maintenance is the largest budgetary item and is a tendered contract. This tender is based on specifications from the City of Calgary.
Yes, the KRA annually applies for a grant, through the Enhanced Landscaping Maintenance (ELM) program, for compensation for work usually done by the City of Calgary.
Multiple attempts, each year, are made to contact owners regarding their HOA fee before extra charges are applied.
Interest Charge: The KRA’s Articles of Association allow for 18% interest to be applied to overdue accounts. These are calculated and applied twice per year. An odd interest amount may result if a partial payment was made, or GST was not paid.
Example: $105 x 18% for 6 months = $ 9.45 $105 x 18% for 1 year = $ 18.90
$210 x 18% for 6 months = $ 18.90 $210 x 18% for 1 year = $ 37.80
Late Fee: Accounts in their second year of arrears have the owner’s contact information verified. The costs are recovered through the application of a $25 Late Fee.
Legal Fee: An arrear account is updated with the cost for the initial demand letter.

To attend a board meeting, please contact the Property Manager with details of your agenda topic. You will be added to the beginning of the agenda and can attend only a portion of the board meeting to respect the privacy of some information discussed. Board meetings are scheduled for the second Tuesday of each month, except July, August and December.
Rather than wait for a board meeting, most matters can be responded to and resolved quickly by the Property Manager, who openly updates the board members. Alternatively, you can make a submission through this website's 'Contact' page.
This information is on each Land Title as a Restrictive Covenant. As each section of Kincora was being built (alias phases) slightly different Restrictive Covenants were filed. Your real estate agent or lawyer should have included this information in your purchase package.
A limited number of Restrictive Covenants have been seen and the copies found consistently mentioned architectural controls which include building theme, soffit/ fascia, parging, overland drainage, adjacent park land, and fencing.
This is not a legal interpretation of the Restrictive Covenants but intended to help with exterior renovation decisions.
An exert about building theme may read:
‘All of the Lots shall be subject to the restrictions and conditions herein set forth which shall be deemed to be covenants running with the land and shall be binding upon and enure to the benefit of the owner or owners of all of the Lots from time to time, such restrictions and conditions having been imposed as a building scheme with a view to maintain the general character of all of the Lots and to controlling the same with respect to the manner of development for residential housing purposes and controlling the drainage thereof.’
‘All soffits, fascia, rainwater leaders and eaves troughs are to be compatible in colour to the rest of the house.’
An exert about who enforces the Restrictive Covenant may read:
‘The restrictive covenants set out herein are enforceable by the owner or owners of each of the Lots to the extent that certain provisions thereof apply to such Lots and any waiver by any owner of any of the said Lots of the strict performance of the covenants set out herein shall not of itself constitute or waiver or abrogate the covenants set out herein.’
All fencing - wood, chain-link, and stone, is maintained by the owners who's property touch the fencing. There are architectural controls attached to every Land Title (restrictive covenants) with details of fencing design, color and maintenance requirements for the property owner.
Through agreements with the City of Calgary, the KRA has approval for the maintenance and landscaping of areas that are overseen by the City of Calgary. This includes turf located between roads/ park spaces, medians and park land. As agreements are updated, details of approved locations are being better understood. There are a limited sections of turf between a road and property that the KRA can maintain. This change has impacted some owners who have had turf maintenance that was not approved by the City of Calgary.
The original developer specified a wood fence color 'Grey Mountain' within the KRA boundary. This has been interpreted as applying to the outer ‘public’ facing side. The inner facing wood fence color (ie backyard) has been left to the discretion of the property owner.

WeatherOne brand is no longer available. ‘Grey Mountain’ is recorded by some paint suppliers as 'Kincora Gray'. An added twist is that there can be different grey tones used in portions of Kincora. Paint suppliers can color match when provided with a small color sample.
This information is found on the Restrictive Covenant attached to each Land Title on KRA homes. Each property can have a unique set of Restrictive Covenants that include specific information about fence design for wooden fencing, chain link fencing, and stone wall features.
All fencing is owned by residents.
